LawCorner Terms and Conditions of Use Agreement

Please read this Terms and Conditions of Use Agreement carefully before using ("the Site") which is operated by Agile Holdings Pty Ltd trading as LawCorner ("us", "we", "our", "LawCorner" or "the Company").

Subject to these Terms and our policies we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Products.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms. 

1. Privacy Policy

We take your privacy seriously. Please see our Privacy Policy for further information.

2. Nature of the Site

LawCorner is not a law firm, does not provide legal advice and is not responsible for any answers or content posted on the site by any member lawyer or other user. LawCorner is a platform through which lawyers may be found and independently hired outside the platform. Any relationship for the provision of such advice or services is solely between the User and the lawyer concerned.

The materials on the Site are provided "as is". LawCorner makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, LawCorner does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Site or otherwise relating to such materials or on any sites linked to or by the Site.

3. No Solicitor-Client (lawyer-client or attorney-client) Relationship

The legal information that appears on LawCorner (including answers to questions and other content) is for general information purposes only and is not intended as legal advice or to create a solicitor-client relationship.

Matters differ according to their facts. The law changes. You should contact a lawyer directly to seek advice specific to your situation. The material here is intended to be a starting point in addressing your legal issues and is no substitute for a longer consultation with a lawyer with expertise in your legal problem who can work through the particular circumstances of your case and be fully informed before providing you with advice.

Questions and answers on LawCorner are not confidential and are not subject to solicitor-client privilege.

4. Legal information on LawCorner

4.1 Member lawyers warrant when they apply for membership on LawCorner that they are legally qualified and hold a current Australian practising certificate. We do not select, screen, approve, endorse or limit who can post legal information including those who contribute responses to questions posted on LawCorner and other contributed content.

4.2 Although we reserve the right to review, remove or edit any content from LawCorner, we do not routinely screen, monitor, or review the content of any legal information. As a result, we have no control over and we do not warrant or guarantee the accuracy, adequacy, applicability, completeness, currency or quality of any such legal information or the qualifications of those posting legal information.

4.3 LawCorner shall have no responsibility or liability of any kind for any professional information you encounter on or through LawCorner, and any use or reliance on legal information is solely at your own risk.

5. Errors and omissions

The material appearing on the Site could include technical, typographical, or photographic errors. LawCorner does not warrant that any of the materials on its website are accurate, complete or current. LawCorner may make changes to the materials contained on its website at any time without notice. While LawCorner will make reasonable endeavours to keep material updated, laws and their interpretation change frequently and it’s unlikely that all material is up to date.

6. Lawyer Profiles

6.1 The information on Lawyer’s Profiles is not intended to be an endorsement of any particular professional, nor is it a guarantee of a professional's quality, competency, qualifications, experience, character, responsiveness or other personal and professional characteristics, nor does it give any indication of the outcome of any matter in which such professional is involved.

6.2 The information provided on this Site is intended to be a starting point to research information about a lawyer who may be suitable for your legal needs, but you should not rely solely on such information in deciding whether to hire any given professional and we strongly advise you to independently verify the accuracy of any information you obtain on LawCorner.

6.3 You agree that you are solely responsible for your use of LawCorner and for carrying out your own research to determine the education, expertise, licensing, good standing and suitability of any legal professional on LawCorner.

7. Relationship between LawCorner and Member Lawyers

7.1 LawCorner accepts applications for membership from legally qualified lawyers who hold a current Australian practicing certificate;

7.2 We reserve the right to cancel the membership of a lawyer at our sole discretion;

7.3 By applying for membership you warrant that you:

(a) Are legally qualified with a current practicing certificate issued in a State or Territory of Australia; and

(b) Will cancel your membership with LawCorner within 7 days of your practicing certificate lapsing or being cancelled.

7.4 There is no financial relationship between LawCorner and its free member lawyers;

7.5 Free members will not be under any obligation to surrender their free membership following the introduction of paid features and services in the future;

7.6 We may identify members in our marketing and promotional materials including on social media, unless a member requests in writing that we do not identify them for this purpose;

7.7 Members who add a new or branch address for a law firm that they work in warrant that they have the authority of the firm to add those details.

7.8 All content provided by members can be re-published, reproduced or distributed beyond LawCorner with attribution to the author.

8. Lawyer Reviews

Lawyer reviews are subject to the following conditions:

8.1 Reviewers are required to register and must provide us with accurate and complete information as to identity and email address;

8.2 The IP address of reviewers are collected and stored by us at the time each review is submitted;

8.3 By submitting a review you warrant that you are a genuine past or current client of the lawyer you are reviewing and that you have had or do have a professional lawyer-client relationship with the lawyer you are reviewing;

8.4 We will not accept reviews from those who are family members, friends, employers, employees, former employers, former employees or professional colleagues of a lawyer, including if the reviewer has had a solicitor-client relationship with a lawyer;

8.5 All reviews are moderated to ensure they are from genuine past or present clients and that the review is appropriate and complies with these terms of use;

8.6 Threats, harassment, hate speech, humiliation, discrimination, lewdness and identification of individuals other than the reviewer and the lawyer will not be tolerated;

8.7 Reviews that concentrate on the outcome of a legal situation rather than the review criteria are unlikely to be accepted;

8.8 LawCorner makes no warranty that a review will be published in part or full. Reviews are published on LawCorner in our absolute discretion;

8.9 Reviewers can elect to have their review published anonymously, however, we will provide your name and email to a lawyer you review, if they request it.

8.10 Fake reviews will not be tolerated. IP addresses are recorded when reviews are submitted and will be provided to police if required;

8.11 Lawyers are prohibited from arranging, or causing to be arranged, the submission of reviews by their friends, family, colleagues, employees and former employees of the lawyer, even if they are an existing or former client of the lawyer;

8.12 Lawyers are prohibited from paying or rewarding, or causing others to pay or reward, others to submit reviews for themselves or others;

8.13 Lawyers are encouraged to invite their current and past clients to submit a review, subject to clause 8.8 of these terms.

9. Beta Release

The LawCorner site, including all software applications and features on the site is in early stage Beta release or prototype form. This means that the Site will contain bugs, errors or other service issues, may be changed, modified or overhauled or deleted.

We encourage you to report any bugs and to make any suggestions for changes or additional features for the site.

LawCorner is not responsible nor liable for any interruptions to, failures, delays, bugs, errors in the service, lack of service or access, inability to upload or download information or any loss or disclosure of information, whether caused by network, system, database, browser, application, code or other failures, errors, interruptions intrusions or hacking, maintenance, difficulties accessing the site, functionality or otherwise, of whatsoever nature howsoever arising.

LawCorner does not provide any guarantee that the service shall be available on an uninterrupted basis, error free or that there shall be no loss or disclosure of information, intrusions, documents or other data or information posted to the site or in relation to the service as a whole.

10. Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. You agree to release and hold LawCorner harmless from any and all claims arising from information loss relating to any information held about or generated by you. We may retain information generated by you on LawCorner beyond termination of you access to the site. 

11. Links To Other Sites

Our Site may contain links to third-party sites that are not owned or controlled by LawCorner. LawCorner has no control over and assumes no responsibility for the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the Terms and Conditions and Privacy Policy of any third-party Site that you visit.

12. Governing Law

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of New South Wales, Australia.

13. Security

We cannot and do not represent or warrant that LawCorner or its server(s), or any content or materials are free of viruses or other harmful components; therefore, you should use industry-recognized software to detect and disinfect viruses, spyware, malware, and other harmful or otherwise undesirable components from any download.

LawCorner does not guarantee, undertake, warrant or represent that there will be no unauthorized access to, disclosure, use, sharing, loss, breach or contamination of the information or that the integrity of the information shall remain intact and preserved. Accordingly, each user bears any and all risk in any and all information loss, howsoever arising, and of whatsoever nature and hereby agrees to release and hold LawCorner harmless from any and all claims arising from information loss relating to information of that user or for which that user is responsible.

14. Intellectual Property

14.1 Trade marks: LawCorner, its logo and other slogans and taglines used within the site and for marketing and promotional purposes are trademarks of the Company and may not be used in whole or part without the Company's prior written permission, including metatags or search engine marketing techniques using the trade marks of the Company;

14.2 Copyright: LawCorner reserves its its rights over the copyrighted materials contained on the Site including the database to which intellect has been applied in order to create it.

 15. Disputes

15.1 For any dispute you have with LawCorner you agree to firstly contact us and attempt to resolve the dispute with us informally;

15.2 If the dispute is unable to be resolved informally you and LawCorner agree to resolve any claim, dispute or controversy by entering into mediation in accordance with, and subject to, The Institute of Arbitrators & Mediators Australia Mediation Rules;

15.3 If the dispute is unable to be resolved in mediation within 30 days (or an extended period agreed by both parties), the parties agree that the dispute will be referred to arbitration in accordance with, and subject to, The IAMA Arbitration Rules.

16. Emails

By using this site you consent to receive emails from us in accordance with the preferences you select in the notifications section of your user dashboard, although you can only opt out of important notices concerning service or account related matters by cancelling your membership (lawyers) or registration (clients). To cancel please contact us.

17. Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

18. Entire Agreement / Severability

These Terms, together with the Privacy Policy and any amendments and/or additional agreements you may enter into with LawCorner shall constitute the entire agreement between you and LawCorner concerning your use of the Site. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and LawCorner's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
